Terms of Service

1. Acceptance of these Terms

Welcome to Turnout RSVP (“Turnout,” “we,” “us,” or “our”). Turnout is a product of Howard Intelligence Technology Systems, LLC (“HITS”). These Terms of Service (“Terms”) govern your access to and use of the Turnout website, mobile applications, and related services (collectively, the “Service”).

By using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Turnout helps people organize events and collect RSVPs. Anyone with a shareable event link can RSVP and participate in event chat without creating an account. Hosts who want to create and manage events can sign in with email, Google, or Apple.

The Service is provided “as is” and may change, expand, or shrink over time. We may add, remove, or modify features at any time.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. Your account

When you sign in as a host, you are responsible for the activity that happens under your account. Keep your sign-in credentials confidential and notify us right away at the contact address below if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe have engaged in fraud, abuse, or unlawful activity.

5. Acceptable use

You agree not to use the Service to:

  • Post or transmit content that is illegal, harassing, hateful, defamatory, sexually explicit involving minors, or that infringes on someone else's rights
  • Impersonate another person or misrepresent your affiliation with someone
  • Send unsolicited bulk messages, spam, or content designed to exploit the Service for marketing without a clear opt-in
  • Attempt to disrupt or compromise the Service's security, scrape data at scale, or reverse-engineer non-public parts of the Service
  • Use the Service to coordinate violence, threats, or activity that places others at risk of physical harm
  • Violate applicable laws or regulations

We may remove content and suspend access without notice if we reasonably believe there has been a violation of these rules.

6. Your content

You retain ownership of the content you submit to Turnout, including event details, attendee names you provide, and chat messages. By submitting content, you grant Turnout a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating the Service — for example, showing your event details to invitees and your chat messages to other participants.

You represent that you have the rights necessary to submit your content and that it does not violate the rights of others.

7. Hosts and event responsibility

If you host an event on Turnout, you are responsible for the event itself — including its accuracy, legality, safety, and any communications you send. We are not the organizer of any event hosted through the Service. Information that hosts and participants share through the Service is shared at their own discretion and risk.

8. Subscriptions and billing

Turnout offers a free tier and one or more paid subscription tiers. Paid tiers unlock features such as recurring event series. Pricing, billing cycles, and feature inclusions are shown on the pricing page.

Paid subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing cycle and you retain access to paid features until that date. Except where required by law, fees already paid are non-refundable.

We may change prices with reasonable notice. Continued use of a paid tier after a price change takes effect constitutes acceptance of the new price.

9. Intellectual property

The Service, including its software, design, name, and logos, is owned by Turnout or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use Turnout's name or logos outside of normal use of the Service.

10. Third-party services

The Service relies on third-party providers (for example, Supabase for database and authentication, Vercel for hosting, Apple and Google for sign-in and push notifications). Your use of features that depend on those providers may also be subject to their terms. We are not responsible for third-party services outside our control.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS WILL BE CORRECTED.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HITS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

13. Indemnification

You agree to indemnify and hold harmless HITS and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if continued provision of the Service to you would expose us to legal or financial risk.

Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnity) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the applicable laws of the United States. Where required by local law, your statutory rights as a consumer are not affected by these Terms.
